Terms & Conditions

By creating an account or using the Call AI App app or website (the
"Service"), you agree to these Terms. If you don't agree, don't use the
Service.
1. Eligibility
You must be at least 13 (or the local minimum age, whichever is
higher) and legally able to form a contract. If you use the Service on
behalf of an organization, you represent that you have authority to bind
that organization.
2. Your account
- You are responsible for everything done with your account. Keep your phone, login credentials, and devices secure.
- One account per person. You may not impersonate others or register under false information.
- We may verify your identity (mobile number) as a condition of service.
3. Wallet, charges, and refunds
- The Service is prepaid. You add credit ("wallet balance") via Stripe, then we deduct usage as it occurs (rentals, calls, messages, AI minutes).
- All amounts are in US Dollars unless otherwise stated. Prices are listed in the app and may change with notice.
- Number rentals are one-time purchases per cycle (no auto-renew). To keep a number you must explicitly renew before the cycle ends.
- Wallet balance is non-transferable, non-withdrawable to cash, and non-refundable except where required by law or where service has materially failed to deliver. Refund decisions are made by us in good faith on a case-by-case basis.
- Purchases via the App Store are governed by Apple's terms in addition to these.
4. Phone numbers
- You do not own the numbers — you rent them through us from upstream carriers (Twilio). We may release a number you have not renewed.
- You may own at most 5 active numbers at a time per account, unless we agree otherwise in writing.
- Number portability (porting in / out) is not currently offered.
5. Acceptable use
You will not, and will not allow others to, use the Service for:
- Robocalling, mass-marketing, autodialed political/marketing campaigns, sweepstakes, or any communication prohibited by the TCPA, GDPR ePrivacy, or equivalent laws.
- Spam SMS, phishing, smishing, scams, or fraud.
- Calls or messages that violate any law (including export controls, sanctions, anti-terror laws).
- Harassment, threats, hate speech, or content sexualising minors.
- Toll-fraud, premium-rate abuse, or any pattern designed to inflate carrier costs.
- Reverse-engineering, scraping our APIs, or building competing services on top of our infrastructure.
- Sharing your account, reselling number access, or operating call centers / dialer farms without prior written agreement.
We may suspend or terminate accounts for any acceptable-use violation, with or without notice. Where suspension is automated by our fraud detector, you may appeal by emailing support@ecomtechbd.com.
6. AI Agent
- When you enable AI Agent on a number, inbound calls are processed by OpenAI's Realtime API. The AI may take messages, send SMS, or transfer the call per the tools and prompt you configure.
- The AI is a software system. It can make mistakes, mishear, or misunderstand. You are responsible for any commitments, transactions, or representations the AI makes on your behalf because the agent operates from a prompt you author.
- You agree not to instruct the AI to engage in any conduct that violates Section 5.
- AI minutes are billed from your wallet at the rate displayed in the Call Rates page. Rates may differ by the country of your number.
7. Service availability
We strive for high availability but do not guarantee uninterrupted
service. Telephony depends on third-party carriers (Twilio, the PSTN,
local mobile networks). We are not liable for outages, missed calls, or
delivery failures caused by upstream providers, your device, your
network, or events outside our reasonable control.
8. Intellectual property
The Service, including its software, designs, and trademarks,
belongs to EcomTech or our licensors. You receive a personal,
revocable, non-exclusive license to use the app for its intended purpose
while these Terms are in effect.
9. Termination
- You may stop using the Service and delete your account at any time (Settings → Delete Account).
- We may suspend or terminate your access for breach of these Terms, fraud, abuse, or as required by law.
- Sections that by their nature should survive termination (Sections 3, 5, 8, 10, 11, 12) survive.
10. Disclaimers
THE SERVICE IS PROVIDED "AS IS", WITHOUT WARRANTY OF ANY KIND, EXPRESS
OR IMPLIED. WE DISCLAIM ALL IMPLIED WARRANTIES OF MERCHANTABILITY,
FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT TO THE FULLEST
EXTENT PERMITTED BY LAW.
11. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, ECOMTECH'S TOTAL LIABILITY
ARISING OUT OF OR RELATED TO THE SERVICE SHALL NOT EXCEED THE AMOUNTS YOU
PAID US IN THE 90 DAYS BEFORE THE CLAIM. WE ARE NOT LIABLE FOR INDIRECT,
INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES.
12. Governing law
These Terms are governed by the laws of Bangladesh, without regard to
conflict-of-laws rules. Disputes will be brought exclusively in the
courts of Dhaka. If you reside in a jurisdiction whose consumer-protection
laws grant you mandatory rights that conflict with this clause, those
rights apply notwithstanding.
13. Changes to these Terms
We may update these Terms as the Service evolves. Material changes
will be announced in-app and become effective on the date posted at the
top. Continued use after that date constitutes acceptance.
